Terms and conditions
The basis on which we quote, ship, clear and deliver. Read section 6 in particular — it covers what we are and are not responsible for.
Last updated: ADD DATE
These terms govern the services provided by ShipIn Logistics to customers importing goods from China into India. By instructing us to proceed with a shipment, you accept them.
1. Definitions
- We, us, ShipIn — ShipIn Logistics, CIN ADD, GSTIN ADD, IEC ADD.
- You, the customer — the person or entity instructing us.
- Services — sourcing, procurement, inspection, freight forwarding, customs clearance, importation and delivery, as applicable to your instruction.
- Consignment — the goods covered by a single instruction.
2. Quotations
Quotations are estimates based on the information you supply and the rates, exchange rates and duty rates applicable when quoted. They are valid for the period stated and are subject to change if:
- The actual volume, weight or dimensions differ from those declared
- The classification, duty rate or applicable exchange rate changes
- Carrier rates, surcharges or terminal charges change
- Additional certification, testing or documentation proves necessary
Figures produced by the landed cost calculator on this website are indicative estimates only and do not constitute a quotation.
3. Your obligations
You are responsible for:
- Giving accurate and complete descriptions of the goods, including value, quantity, weight and dimensions
- Telling us of anything hazardous, restricted, regulated or requiring special handling
- Confirming that the goods may lawfully be imported into India and that you may lawfully deal in them
- Providing documentation and information we reasonably request, without delay
- Paying amounts due under clause 4
- Being available, or having someone available, to take delivery
Providing an inaccurate description or value may cause delay, penalty, seizure or additional duty. Costs arising from inaccurate information supplied by you are yours.
4. Charges and payment
- Charges are payable as set out in the quotation or invoice.
- Duty, taxes, terminal charges, demurrage, detention, storage and examination charges are payable by you at cost where they arise, including where they arise through no fault of ours.
- Where we advance duty or third-party charges on your behalf, they are reimbursable.
- We may withhold release or delivery of a consignment until sums due are paid.
- Where goods are supplied by us to you within India, a GST invoice is issued and GST is charged at the applicable rate.
5. Importation on our IEC
Where you have asked us to import goods on our own Importer Exporter Code:
- We are the importer of record and are named on the bill of entry.
- We pay customs duty and applicable taxes at the border.
- The goods are then supplied to you within India against a GST invoice, as a domestic supply.
- You do not receive the bill of entry or customs documentation, and you do not acquire the status or benefits of an importer in respect of that consignment.
- You remain responsible for confirming that the goods are lawful and correctly described.
6. Liability
We act with reasonable skill and care. However:
- We are not liable for delay, loss or damage caused by carriers, customs authorities, port, terminal or CFS operators, or other third parties.
- We are not liable for delay or loss caused by events outside our reasonable control, including weather, port congestion, strikes, vessel or flight cancellation, regulatory change or public authority action.
- We are not liable for goods held, seized or confiscated as a result of incorrect information supplied by you, or as a result of the goods being restricted or prohibited.
- We are not liable for indirect or consequential loss, including loss of profit, loss of sale, loss of market or business interruption.
- Where cargo insurance has not been arranged, loss or damage in transit is not covered by us.
Except in respect of liability that cannot be excluded by law, our total liability in respect of any consignment is limited to the charges we received for our services on that consignment.
7. Insurance
Marine and air cargo insurance is available and is quoted separately. It is not automatic and is not included unless expressly stated. Where you decline cover, the risk of loss or damage in transit is yours.
8. Inspection
A standard pre-shipment check covers quantity, packing and visible condition against the approved sample. It is a visual and sampled check, not a laboratory test, and it does not certify compliance with any Indian standard. Latent defects, internal faults and non-conformity not visible on inspection are matters between you and the supplier.
9. Prohibited and restricted goods
We do not handle goods that are prohibited under Indian import policy, and we do not handle restricted goods without the required approval. Where a category requires certification or registration before customs will release it, that requirement applies regardless of who imports the goods. We identify such requirements at the enquiry stage where possible, but confirming that goods may lawfully be imported remains your responsibility.
10. Cancellation
Where you cancel after we have incurred costs — supplier payment, freight booking, warehouse handling or clearance work — those costs are payable. Cancellation after a consignment has shipped is not generally possible.
11. Claims
Claims for shortage or visible damage must be notified within 7 days of delivery, with photographs. Claims notified later, or without evidence, cannot normally be pursued with the carrier or insurer.
12. Governing law
These terms are governed by the laws of India. The courts at Hyderabad, Telangana have exclusive jurisdiction.
